1. Website Terms of Use

Bluey Merino Tasmania ("Website Owner", "we", "us", or "our") owns and operates this website. Access to and use of this website and the products and services available through it (collectively, "Services") are subject to the following terms, conditions, and notices. By using the Services, you are agreeing to all of these Terms & Conditions, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made.

2. Our Contract

When you place an order via our website, you will receive an acknowledgement email confirming receipt of your order. This email is an acknowledgement only and does not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by email that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.

3. Pricing, Currency, and GST

  • (a) All prices, payments, and references to '$' are in Australian Dollars (AUD).
  • (b) All prices are inclusive of Australian Goods and Services Tax (GST) where applicable.
  • (c) While we strive for accuracy, errors may occur. If we discover a pricing error on your order, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it for a full refund.

4. Stock Availability

  • (a) We endeavour to supply all items publicised on our online store, but there may be occasions where part of your order cannot be fulfilled immediately or at all.
  • (b) Where an item is unavailable, you will be advised as soon as possible by email or telephone and the purchase price of the unavailable item will be refunded.

5. Refunds, Exchanges, and Wool Care

Your purchase is subject to our Returns & Exchanges Policy, which is incorporated into these Terms.

  • (a) Consumer Guarantees: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure.
  • (b) Wool Care: Bluey Merino garments are made from high-performance natural fibres. You agree to follow the specific care instructions on the physical garment label or, where no physical label is present, on the specific product page of our website (How to Wash).
  • (c) Exclusions: We are not liable for damage, shrinkage, or pilling caused by improper laundering (e.g. hot cycles, harsh detergents, or tumble drying) where instructions were available. Damage from moths, insects, or snags occurring after delivery is not considered a manufacturing fault.

6. Shipping and Risk

  • (a) Responsibility in Transit: We are responsible for your order until it has been delivered to your nominated address.
  • (b) Risk and Stolen Parcels: Once the carrier provides Proof of Delivery (e.g. GPS tag or photo), the risk of loss or theft passes to you. We are not liable for parcels stolen from your property after successful delivery.
  • (c) Safe Drop: If you choose "Authority to Leave" or a "Safe Drop" location, you do so at your own risk.

7. Payment and Security

  • (a) Payment can be made through the following secure methods available at checkout: PayPal, Shop Pay, Apple Pay, Google Pay, and Bank Deposit.
  • (b) By using this website, you warrant that you have familiarised yourself with and agree to be bound by the applicable Terms and Conditions of your chosen payment provider.
  • (c) Credit card numbers are not stored on our website or servers.

8. Limitation of Liability

  • (a) We have no liability to the extent that our performance of the contract is prevented by Force Majeure (e.g. natural disasters, epidemics, or industrial action).
  • (b) To the maximum extent permitted by law, we disclaim liability for any indirect or special loss or damage incurred in respect of goods or services supplied.

9. Governing Law

These Terms & Conditions are governed by the laws of Tasmania. Both parties submit to the non-exclusive jurisdiction of the courts of Tasmania.
